II. Personal data that will be processed

For the purposes indicated in this privacy notice, we collect directly (you yourself provide them to us during your visit to the clinic and / or by various means such as telephone, email or social networks) the following personal data and sensitive data: name, surname, address, age, sex, anthropometric measurements, blood group, ethnicity and other specific data of your health status in general, in addition to your mobile or landline phone, email and, additionally, in the case of requiring billing, the Federal Taxpayer Registry.

Said data is treated under strict security measures that guarantee its confidentiality.

III. Purposes of the treatment

In terms of Article 16 of the Federal Law for the Protection of Personal Data in Possession of Private Parties and 41 of its Regulations, we inform you that your personal information will be used for the purpose of providing the products and/or services requested; in case we do not have this information, we would not be able to perform any evaluation and/or procedure, considering the following purposes:
● To create a history about your health status (clinical record).
● To provide services and products required and to follow up on the results obtained.
● To inform about new products or services that are related to the one you have acquired.
● Fulfill our obligations to you.
● To inform you about changes to our services.

IV. Transfer of data

For the provision of Art Line’s services, it may transfer personal data in its possession to medical personnel, hospitals, clinics, study and research institutions, laboratories, insurance companies and subcontracted third parties, exclusively for the purposes indicated in this privacy notice.

V. Means and Procedure for Revoking Consent and Exercising Arco Rights

You have the right to (i) access the personal data we hold and the details of the processing thereof, as well as to (ii) rectify them in case they are inaccurate or incomplete; (iii) cancel them when you consider that they are not required for any of the purposes indicated in this privacy notice, are being used for non-consensual purposes or the provision of legal services has ended, or (iv) oppose the processing thereof for specific purposes (the “Arco Rights”). You may also revoke your consent to the processing of your personal data as long as they are not necessary for the provision of services.

A. Arc Request Requirements

In terms of the Federal Law for the Protection of Personal Data in Possession of Individuals, any Arco Rights Request (“Arco Request”) must comply with the following requirements:

Indicate the name of the owner of the data and his address, or other means to communicate the response to your request.
Accompany the documents that allow to prove your identity, or in your case, the representation of the owner of the data.
Provide a clear and precise description of the personal data with respect to which you are seeking to exercise any of the Arco Rights. In the case of rectification of personal data, you must indicate the modifications to be made and provide the documents supporting your request.
Indicate and/or attach any other element or document that facilitates the location of the personal data.

B. Means to submit the Arco Requests or revoke consent

Data owners may submit such requests directly to Art Line’s offices, located at José María Velazco 2488, 7th floor, Zona Urbana Rio Tijuana, 22010 Tijuana, B.C. The data owner must prove his/her identity by means of a copy of his/her identification document and must show the original for comparison. The following identification documents are accepted: voting card, passport and professional license. -If a representative attends, he/she must prove: (i) the identity of the owner of the data; (ii) his/her identity as representative, and (iii) the existence of the representation, by means of a public instrument or power of attorney signed before two witnesses, through the declaration of the owner in personal appearance. -Acknowledgement of receipt of the Arco Request, indicating the date of receipt, will be delivered to the data owner or his/her representative.

C. Deadline for the attention of Arco Requests

In the event that the information provided in the Arco Request is insufficient or erroneous to process it, or if the necessary documents to process it are not provided, Art Line will require the data owner or his representative, within 5 business days following the receipt of the Arco Request, for a single time, to provide the necessary elements or documents to process it. The owner of the data or its representative will have 10 working days from the day following the receipt of the request to respond. Art Line will respond to the ARCO Request with the determination reached, within 20 working days from the reception of the request, or in case additional information or documents have been requested, within 20 working days from the day following the presentation of the response to the request. In case the ARCO Request is granted, Art Line will make effective the determination reached within 15 working days from the date the response is communicated to the data owner or his representative. In the case of ARCO Requests regarding the right of access to personal data, the delivery of the data will be made upon accreditation of the identity of the data owner or his representative. Art Line may extend the deadlines to respond to an ARCO Request and/or to make effective the determination reached, only once, for periods equal to those indicated in each case, provided that it considers that the circumstances of the case justify it. In such cases, Art Line will notify the data owner or his representative, the circumstance(s) that justify the extension, within each of the original deadlines to respond or to make effective the determination reached. Responses to ARCO Requests will be delivered to the data owner or its representative. The requested information or personal data may be made available to the data owner or his representative, in simple copies or in electronic file according to the type and quantity of documents involved in each case. For the revocation of consent, it will be sufficient for the owner to present his request at Art Line’s address. Art Line will give a positive response and will make the request effective, provided that it does not concern personal data necessary for the existence, maintenance and fulfillment of its medical relationship with the data subject.

D. Changes to the privacy notice
